TOPIC: Damages for Catastrophic Injury and Psychological Trauma
When a claim for catastrophic injury is made, there are numerous issues that arise with respect to the proper quantification of the various heads of damage. The potential damages available can be quite significant making the quantification and management of the damages case important. We will explore the legal and practical issues that arise in the defence of catastrophic injury cases from onset to conclusion. Unlike many physical injuries, psychological trauma does not show up on an x-ray or an MRI. How severe does a psychological effect from an incident have to be in order to warrant compensation? How are such injuries established to a legal standard? What role do experts play in this area? These issues will be explored in the context of the recent decision of the Supreme Court of Canada in Saadati v. Moorhead.SPEAKERS: Dianna S. Hwang and Jeremy M.
